Power v. Fenno
Massachusetts Supreme Judicial Court
Power v. Fenno, 76 Mass. 249 (Mass. 1857)
Shaw
Power v. Fenno
Opinion of the Court
The obligation of Donahue was to appear in court and abide the order. It appears that he was there personally present when the order was made. He was committed, either then or afterwards, in pursuance of that order. It was by the act of the complainant that he was so committed, and she is estopped to say that he did not abide the order of the court to pay or be committed.
Exceptions overruled.
