Tanner v. Freeland

Opinion of the Court

THIS was an appeal from Calvert County Court on a scire facias brought against Freeland,, as administrator of Ball, to have execution of a judgment against the intestate. He pleaded plene administravit generally. Replication and the Jury find for the defendant. Error. Because plene administravit generally is no bar on a scire facias, to have execution on a judgment. Cro. Eliz. 575. 5 Co. 28. 4 Co. 59 b. 2 Brown. 39.81,82. 2 Leon. 370. 1 Leon. 328.

Judgment affirmed.
