JONKER DANIEL HEYNS, et al., Defendants. / ORDER APPROVING MAGISTRATE'S REPORT AND RECOMMENDATION The Court has reviewed the Report and Recommendation filed by the United States Magistrate Judge in this action on August 20, 2021 (ECF No. 95). The Report and Recommendation was duly served on the parties. On September 9, 2021, the Court granted plaintiff an extension to September 16, 2021, to file objections. No objections have been filed under 28 U.S.C. § 636(b)(1)(C).

ACCORDINGLY, IT IS ORDERED that the Report and Recommendation of the Magistrate Judge (ECF No. 95) is approved and adopted as the opinion of the Court.

IT IS FURTHER ORDERED that defendants’ motion for summary judgment (ECF No. 74) is GRANTED.

IT IS FURTHER ORDERED that this matter is TERMINATED.

IT IS FURTHER ORDERED that Petitioner is denied a certificate of appealability.
