The matter was referred to the Magistrate Judge, who issued a Report and Recommendation (ECF No. 26) on February 21, 2025, recommending that this Court deny Plaintiff’s motion and grant Defendant Rife’s motion. The Report and Recommendation was duly served on the remaining parties. No objections have been filed. See

(b)(1). Accordingly: IT IS HEREBY ORDERED that the Report and Recommendation (ECF No. 26) is APPROVED and ADOPTED as the Opinion of the Court. IT IS FURTHER ORDERED that Plaintiff’s Motion for Summary Judgment (ECF No. 23) is DENIED. IT IS FURTHER ORDERED that Defendant Rife’s Motion for Summary Judgment (ECF No. 20) is GRANTED. IT IS FURTHER ORDERED that this Court certifies pursuant to
