The complaint for *1125superintending control is dismissed because another adequate remedy, an appeal, is available to appellant. GCR 1963, 711.2, 711.4(b). This action is taken without prejudice to the filing, by appellant, of an application for leave to appeal. The petition for appointment of counsel is denied.
