The points raised in this case are identical with those considered and determined in the case of Webster v. Luther, 50 Minn. 77, (52 N. W. Rep. 271,) after full argument. This case must therefore be held to be governed by that, and the judgment of the trial court in accordance therewith is accordingly affirmed.
