This matter having been brought on for hearing upon testimony taken by and before a referee, and the court having *198duly examined and considered the same, and being of the opinion that the charges made against said Jasper N. Searles are not sustained by said testimony, it is ordered that the proceedings against him be, and they hereby are, dismissed.
