June 1, 2020 In re Proposed Recall Petition to STATE OF MINNESOTA IN SUPREME COURT A20-0748 Request the Recall of Timothy James Walz, Governor of the State of Minnesota. ORDER On May 26, 2020, the briefing order filed in this matter directed the persons proposing the petition to recall the Governor of the State of Minnesota to file any additional materials supporting the proposed petition, along with proof of service, with the Clerk of the Appellate Courts by 4:30 p.m. on May 29, 2020. Petitioners were also required to personally serve these materials on Governor Timothy Walz or his designated representative by the same deadline. It further directed Governor Timothy Walz to file any materials opposing the proposed petition, along with proof of service, with the Clerk of the Appellate Courts by 4:30 p.m. on June 2, 2020, and to personally serve these materials on the designated representatives of the persons proposing the petition by the same deadline. On the morning of May 29, 2020, the petitioners contacted the Clerk of the Appellate Courts and requested an extension of the May 29 deadlines. By verbal order, petitioners' deadlines were extended to 4:30 p.m. on June 3, 2020, and they were authorized to complete service electronically and by United States mail. After issuance of this verbal order, Governor Timothy Walz contacted the Clerk of the Appellate Courts on May 29, 2020, and requested an extension of his June 2 deadlines. Again by verbal order, Governor Walz's deadlines were extended to 4:30 p.m. on June 5, 2020, and he was authorized to complete service electronically and by United States mail. This order confirms the verbal orders issued on May 29, 2020. Based upon all the files, records, and proceedings herein, IT IS HEREBY ORDERED THAT: 1. The persons proposing the petition shall provide the undersigned with any additional materials, factual or legal, supporting the proposed petition by filing those materials, along with proof of service, with the Clerk of the Appellate Courts using the appellate courts' e-filing application, E-MACS, if required to do so. See Minn. R. Civ. App. P. 125.0l(a)(l). All materials shall be filed so as to be received no later than 4:30 p.m. on June 3, 2020. One copy of all such materials shall be served electronically and by United States mail on the attorneys representing Governor Timothy Walz by the same deadline. 2. Governor Timothy Walz may submit any materials, factual or legal, opposing the proposed petition by filing those materials, along with proof of service, with the Clerk of the Appellate Courts, using the appellate courts' e-filing application, E-MACS, if required to do so. See Minn. R. Civ. App. P. 125.0l(a)(l). All materials shall be filed so as to be received no later than 4:30 p.m. on June 5, 2020. One copy of all such materials shall be served electronically and by United States mail on the designated representatives of the persons proposing the petition by the same deadline.
