Everitt v. Jack
Mississippi Supreme Court · Decided December 12, 1966 · Brady, Ethridge, Jones, Patterson, Smith
192 So. 2d 698; 1966 Miss. LEXIS 1266 (Southern Reporter, Second Series)

Everitt v. Jack

Opinion of the Court

BRADY, Justice.

There is no substantial difference in the material facts and legal issues involved in this case and those in the case of Everitt v. Lovitt, 192 So.2d 422 (Miss. Nov. 28, 1966). For this reason, by agreement of all parties concerned, these two causes were consolidated. Therefore, this case is controlled by the decision rendered in the Lovitt case.

Reversed and judgment rendered here.

ETHRIDGE, C. J., and JONES, PATTERSON and SMITH, JJ., concur.
