ETHRIDGE, Chief Justice:

The decision in this case is controlled by Mississippi State Department of Public Safety v. Berry, 217 So.2d 11 (Miss. Dec. 2, 1968). See also Annot., 97 A.L.R.2d 1367 (1964); 7 Am.Jur.2d Automobiles and Highway Traffic, §§ 123, 124 (1963); Fisher, Vehicle Traffic Law, 268-288 (1961). Thus the judgment of the circuit court is reversed and judgment is rendered here vacating the writ of certiorari.

Reversed and rendered.
