Plaintiff has filed a motion for leave to file an amended complaint. (Doc. 10.) Pursuant to Rule 15 of the Federal Rules of Civil Procedure, “[a] party may amend its pleading once as a matter of course no later than . . . 21 days after service of a motion under Rule 12(b) . . . .” Fed. R. Civ. P. 15(a)(1)(B). A motion to amend filed while the plaintiff is entitled to an amendment as a matter of course is an “unnecessary request.” Sparling v. Hoffman Constr. Co.,
