Supreme Court of North Carolina, 1863

Summey v. . Johnston

Summey v. . Johnston
Supreme Court of North Carolina · Decided June 5, 1863 · PEARSON, C. J.,
60 N.C. 98
Summey v. . Johnston

Opinion of the Court

We concur in the opinion of his Honor, that the summary mode of proceeding can only be resorted to where the clerk has "admitted money tobe due" in the manner prescribed by Rev. Code, ch. 73, sec. 1. On a perusal of the statute, this is so clear as not to admit of discussion.

PER CURIAM. Affirmed.
