Tbe motions in tbe case at bar present tbe same questions that were just decided by us in tbe case of Burger v. Sinclair [next case] 140 N. W. 235, and tbe decision in tbat case controls tbis. Tbe same order will accordingly be made herein, with tbe exception tbat no costs are allowed.
