Opinion of the Court
This is a. proceeding for disbarment. The complaint and petition charges the practical embezzlement of two items of $22.50 and $4.75 respectively, which are alleged to have been collected for clients and not turned over.
The proceedings will therefore be dismissed.
Concurring Opinion
I concur on the ground that the guilt of the defendant is not so clearly established on the first charge as to justify his disbarment, and his failure to account for the second item promptly is reasonably explained.
