This is a companion case of First State Bank v. Cox, *180ante, 175, 237 N. W. 708. It was tried on tbe same statement of facts and tbe same briefs. Following tbe decision in tbe said First State Bank v. Cox, ante, 237 N. W. 708, decided at tbis term and for tbe same reasons tbe judgment in tbis case is affirmed.
