The authority of the county superintendent to maintain an action of this nature is specifically conferred by section 11, subdivision 3, chapter 79, Compiled Statutes (Annotated Statutes, sec. 11055), and has been approved by this court in Montgomery v. State, 35 Nebr., 655, 659.
The only contention urged against the alloAvance of the writ is that the contract was not entered into at a. regular meeting of the board. This contention, we think, is Avith-out merit, in vieAV of the provisions of section 13, subdivision 4, chapter 79, Compiled Statutes (Annotated Statutes, sec. 11068), Avliich is as folhnvs: “The director shall, Avith the concurrence of the moderator and treasurer, or either of them, provide the necessary appendages for the schoolhouse, and keep the same in good condition and repair during the time school shall be taught in said schoolhouse, and shall keep an accurate account of all expenses incurred
It is therefore recommended that the judgment of the district court be affirmed.
For the reasons stated in the foregoing opinion, the judgment of the district court is
Affirmed.
