Opinion of the Court
The injunction will be dissolved. The question whether Hamilton is dead, or is to be deemed under the circumstances to be dead, may be tried quite as properly, and perhaps much more satisfactorily in the ejectment suit. Acting on this ground in dissolving the injunction, I forbear making any remarks as to sufficiency or insufficiency of the facts stated in the bill to show that Hamilton is dead.
