Supreme Court of New Jersey · Decided September 15, 1827 · Ewing
9 N.J.L. 246
Skillman v. Coolbaugh

Opinion of the Court

Ewing, C. J.

enquired -whether the application was made on behalf of the defendant, and said, we do not all suppose that it is necessary that you should enter an appearance in order to move to quash the writ, but then you must move on the part of the defendant himself. If such be the fact you may take the rule.
