The plaintiff in this case having died since the entry of the judgment, his administrators now apply to be substituted plaintiffs in order to issue a testatum fi. fa.

Per Curiam.

The remedy in such a case is a scire facias, which may issue without a rule.-

Note. — -Elmer, Justice was absent during the first and second weeks of the term, being engaged in holding the Cumberland and Salem Circuits.
