1 MEMORANDUM OPINION CASTILLO, Judge.

3 The State of New Mexico appeals the district court’s grant of Defendant’s motion to suppress evidence. On August 30, 2010, this Court filed a notice of proposed summary disposition proposing to affirm. On September 22, 2010, the State filed a notice that it will not file a memorandum in opposition to proposed summary affirmance.

8 Accordingly, for the reasons set forth in the notice of proposed summary disposition, we affirm the district court.
