8 9 On January 11, 2021, Magistrate Judge Weksler ordered plaintiff Aaron Hugh Deaton to 10 file a complaint and a fully complete application to proceed in forma pauperis or pay the full filing 11 fee of $402 by February 1, 2021. ECF No. 3 at 2. The February 1, 2021 deadline has now expired, 12 and Deaton has not filed a complaint or a fully complete application to proceed in forma pauperis, 13 paid the full $402 filing fee, or otherwise responded to Judge Weksler’s order. 14 District courts have the inherent power to control their dockets and “[i]n the exercise of 15 that power, they may impose sanctions including, where appropriate . . . dismissal” of a case. 16 Thompson v. (9th Cir. 1986). A court may 17 dismiss an action, with prejudice, based on a party’s failure to prosecute an action, obey a court 18 order, or comply with local rules. See Ghazali v. Moran,

(9th Cir. 2 1986) (affirming dismissal for lack of prosecution and failure to comply with local rules). 3 In determining whether to dismiss for these reasons, the court must consider several 4 factors: (1) the public’s interest in expeditious resolution of litigation; (2) the court’s need to

5 manage its docket; (3) the risk of prejudice to the defendants; (4) the public policy favoring 6 disposition of cases on their merits; and (5) the availability of less drastic alternatives. See 7 Thompson,

. 9 Here, the first two factors (the public’s interest in expeditiously resolving this litigation 10 and my interest in managing the docket) weigh in favor of dismissal. The third factor (risk of 11 prejudice to the defendants) also weighs in favor of dismissal because a presumption of injury 12 arises from the occurrence of unreasonable delay in filing a pleading ordered by the court or 13 prosecuting an action. See Anderson v. Air West,

542 F.2d 522, 524

(9th Cir. 1976). The fourth 14 factor (public policy favoring disposition of cases on their merits) is greatly outweighed by the

15 factors in favor of dismissal discussed herein. Finally, a warning to a party that his failure to 16 obey the court’s order will result in dismissal satisfies the “consideration of alternatives” 17 requirement. Ferdik,

Judge Weksler’s order expressly stated: “IT IS FURTHER ORDERED that failure to 19 timely comply with this order may result in a recommendation to the district judge that this case 20 be dismissed.” ECF No. 3 at 2.
