2266 Pursuant to Federal Rule of Civil Procedure 16, Local Rule of Civil Procedure 7-1, and this 2277 Court’s January 12, 2021 Scheduling Order, Plaintiff United States of America and Defendants Las Vegas Jaycees Senior Citizens Mobile Home Community, Newport Pacific Capital Company, Inc. 11 22 and Sherry Polley-Tompkins (“Defendants”) (collectively, the “Parties”) respectfully request this 33 Court to enter a stay of all proceedings and deadlines, including the discovery deadline, until August 44 31, 2021, in order to allow the Parties to continue to focus on settling the case. There is good cause 55 to grant the requested stay. 66 In support of this joint motion, the Parties submit: 77 1) This case was filed on September 29, 2020. On January 12, 2021, the Court entered a 88 scheduling order, which provided for, among other things, a discovery period ending on July 23, 99 1100 2021. See Dkt. No. 14. Since that time, the Parties have engaged in discovery. 1111 2) Recently, the Parties have engaged in settlement discussions. Currently, the Parties 1122 are close to reaching a settlement that will resolve all claims. 1133 3) Because the Parties are close to an agreement on settlement, they have agreed to stay 1144 discovery and the other deadlines in the case to focus on settlement and conserve the Court’s and the 1155 Parties’ resources. 1166 4) Courts have broad discretion to stay proceedings for a limited time. P. 16(b)(4) (a scheduling order may be modified for good cause and with the Court’s consent). 2244 2255 5) This stipulation is filed in good faith and not for the purpose of delay. 2266 6) The Parties have not previously requested a stay from the Court. 2277 7) Because a trial date has not been set, a stay will not interfere with the Court’s trial 11 22 calendar or prejudice the Parties. 33 8) If the matter is not concluded by August 31, 2021, the Parties will file a notice with 44 the Court apprising it of the status of settlement discussions or seeking to lift the stay. 55 For the above reasons, the Parties respectfully request this Court stay the proceedings and 66 deadlines in this matter until August 31, 2021. 77
