RECOMMENDATION OF U.S. MAGISTRATE JUDGE 7 GIANNA VERNESS, et al.. 8 Defendants. 9 10 In December 2024, Plaintiff Donald Deloney, a pretrial detainee in the 11 custody of the Washoe County Detention Center, filed this civil rights lawsuit. 12 (ECF No. 1-1.) The Court ordered Deloney to either pay the filing fee or submit an 13 application to proceed in forma pauperis. (ECF No. 3.) The Court warned Deloney 14 that failure to do so may result in dismissal of this case without prejudice. 15 Deloney failed to pay the filing fee or apply to proceed in forma pauperis and has 16 not filed any other documents in this case. Magistrate Judge Carla Baldwin 17 issued a report and recommendation recommending that this action be dismissed 18 without prejudice. (ECF No. 4.) 19 Under the Federal Magistrates Act, a Court “may accept, reject, or modify, 20 in whole or in part, the findings or recommendations made by [a] magistrate 21 judge.”

(b)(1). Where a party timely objects to a magistrate judge's 22 report and recommendation, the court is required to “make a de 23 novo determination of those portions of the [report and recommendation] to which 24 objection is made.”

(b)(1). A court is not required to conduct “any 25 review at all . . . of any issue that is not the subject of an objection.” Thomas v. 26 Arn,
