[ECF No. 32] 16 Defendants Adam Main, Francisco Barrios, and William Miller by and through 17 counsel, Aaron D. Ford, Nevada Attorney General, and Douglas R. Rands, Senior Deputy 18 Attorney General, of the State of Nevada, Office of the Attorney General, hereby submit 19 their Unopposed Motion for an Extension of Time to File Response to Discovery. 20 Defendants seek an extension of time from September 26, 2025 to October 27, 2025. 21 I. INTRODUCTION 22 Defendants respectfully request this Court grant their request to extend the 23 deadline to file the response to Plaintiff’s Request for Production of Documents. The parties 24 conducted a meet and confer telephone conference on September 25, 2025, wherein the 25 parties agreed to a 30-day extension of time to file the response. This was primarily because 26 of the ongoing cyber event. The files of the Office of the Attorney General remain 27 inaccessible. Therefore the documents necessary to fulfill the requests are not available. 28 /// 2 cause exists to grant the instant motion for extension of time. 3 II. LEGAL ARGUMENT 4 District courts have inherent power to control their dockets. Hamilton Copper & 5 Steel Corp. v. Primary Steel, Inc.,

Rule 6(b)(1), Federal Rules of Civil Procedure, governs 7 extensions of time: 8 When an act may or must be done within a specified time, the court may, for good cause, extend the time: (A) with or without 9 motion or notice if the court acts, or if a request is made, before 10 the original time or its extension expires; or (B) on motion made after the time has expired if the party failed to act because of 11 excusable neglect. 12 “The proper procedure, when additional time for any purpose is needed, is to present 13 to the Court a timely request for an extension before the time fixed has expired (i.e., a 14 request presented before the time then fixed for the purpose in question has expired).” 15 Canup v. Miss. Valley Barge Line Co.,

(D. Pa. 1962). The Canup Court 16 explained that “the practicalities of life” (such as an attorney’s “conflicting professional 17 engagements” or personal commitments such as vacations, family activities, illnesses, or 18 death) often necessitate an enlargement of time to comply with a court deadline.

19 Because of the ongoing cyber event, the files of the Office of the Attorney General 20 remain inaccessible. Therefore the documents necessary to fulfill the requests are not 21 available. Mr. Parker agreed to the filing of an unopposed motion.
