Howard (Abdul) v. State

Opinion

IN THE SUPREME COURT OF THE STATE OF NEVADA

ABDUL HOWARD, No. 72523 Appellant, vs. THE STATE OF NEVADA, i. FILED Respondent. SEP 13 2017

ORDER OF AFFIRMANCE This is a pro se appeal from an order denying a petition for a writ of mandamus.' Eighth Judicial District Court, Clark County; Douglas Smith, Judge.

In his petition, appellant Abdul Howard sought resolution of a 2015 postconviction petition for a writ of habeas corpus in district court case number C189799. Based upon our review of the record on appeal, we conclude that the district court did not err in denying the petition because a petition for a writ of mandamus is the improper vehicle for requesting such relief in the district court. See NRS 34.160. Accordingly, we ORDER the judgment of the district court AFFIRMED.
