Sigal (Jeremy) v. State

Opinion

IN THE SUPREME COURT OF THE STATE OF NEVADA

JEREMY EVAN SIGAL, No. 75377 Appellant, vs. FILED THE STATE OF NEVADA, Respondent. JUN 1 7 2019 ELIZABEM A. BROWN CLERK OF SUPREME COURT BY 5* DEPUTY CLERK ORDER OF AFFIRMANCE This is a pro se appeal from a district court order denying a motion to modify sentence.1 Eighth Judicial District Court, Clark County; William D. Kephart, Judge.

In his motion filed on February 28, 2018, appellant claimed the prosecutor overstated the facts regarding his termination from the DUI court/deferred sentencing program, embellished the threat to the community, and misstated that he was on probation when he committed the offense in this case. Appellant failed to demonstrate that the district court relied on mistaken assumptions regarding his criminal record that worked to his extreme detriment. See Edwards v. State, 112 Nev. 704, 708, 918 P.2d 321, 324 (1996). Accordingly, we ORDER the judgment of the district court AFFIRMED.
