Order of confirmation and report of referee modified by reducing the damages, as found by the referee, to the sum of $393.20,—being the sum of $250 for counsel fees, and the sum of $143.20 for costs and expenses of the referee; and, as so modified, affirmed, without costs of this appeal to either party. All concur. See 40 N. Y. Supp. 459.
