Judgment of the Municipal Court reversed and new trial ordered, costs to abide the event, on the authority of Barnett v. Brooklyn Heights R. R. Co. (53 App. Div. 432) and People v. Brooklyn Heights R. R. Co. (187 N. Y. 48). Jenks, Hooker, Gaynor, Rich and Miller, JJ., concurred. •
