Per Curiam:

The order is reversed, with ten dollars costs and disbursements, and the motion denied, with ten dollars costs, without-passing upon the question whether the plaintiff upon a trial would be entitled to a final injunction specifically enforcing this agreement, Present'—Ingraham, P. J., McLaughlin, Clarke, Scott and Dowling, JJ.; Dowling, J., dissented. Order reversed, with ten dollars costs and disbursements; and motion denied, with ten dollars costs.
