Opinion of the Court

The evidence conclusively establishes that plaintiff’s assignor was paid §300 on October 6,1909, by being credited with that sum on his bond secured by a mortgage on his wife’s house on nineteenth avenue. Judgment of the Municipal Court modified by deducting therefrom the sum of §300, with interest from October 6, 1909, to the date of the entry of the judgment, and as modified affirmed, without costs Hirschberg, P. J., Woodward, Burr, Thomas and Rich, JJ., concurred.
