Per Curiam:

Without passing upon the question as to whether the plaintiff would be entitled to any relief upon the tidal of the action, we think the order appealed from should be reversed, with ten dollars costs and disbursements, and the motion for a. temporary, injunction denied, with ten dollars costs. Present — Ingraham, P. J., Laughlin, Clarke, Scott and Dowling, JJ. Order reversed, with ten dollars costs and disbursements, and motion denied, with ten dollars costs.
