People v. Eissing Chemical Co.
Appellate Division of the Supreme Court of New York · Decided June 15, 1916
174 A.D. 895; 159 N.Y.S. 1133
People v. Eissing Chemical Co.

Opinion of the Court

Judgment of conviction by the Court of Special Sessions reversed, and new trial ordered. The fire commissioner’s power to make the order set forth in the information did not sufficiently appear. The ordinances and regulations referred to are not subjects of judicial cognizance, unless proved. (Goetz v. Duffy, 171 App. *896Div. 680, 682.) Jenks, P. J., Thomas, Carr, Stapleton and Putnam, JJ., concurred.
