J., Mills, Putnam and Kelly, JJ., concur; Blackmar, J., dissents on the ground that the city of New York has no interest in this controversy for the reasons stated in his dissenting opinion in Morrell v. Brooklyn Borough Gas Co., No. 1 (ante, p. 7), decided herewith.
