Pure Ice Co. v. Smyth

Pure Ice Co. v. Smyth
Appellate Division of the Supreme Court of New York · Decided June 15, 1921
198 A.D. 918
Pure Ice Co. v. Smyth

Opinion of the Court

Judgment reversed and new trial granted, with costs to appellant to abide the event. The court committed reversible error in excluding evidence offered by defendant tending to show that he paid for the stock in question, for the reason that evidence of such payment was not properly set forth in the company’s books. Blaekmar, P. J., Mills, Rich, Kelly and Manning, JJ., concur.
