Staniewski v. Johnston

Staniewski v. Johnston
Appellate Division of the Supreme Court of New York · Decided July 15, 1921
198 A.D. 966
Staniewski v. Johnston

Opinion of the Court

Judgment affirmed, with costs. All concur, except Davis, J., who dissents and votes for reversal upon the ground that the plaintiff was a beneficiary of the fraud, was not an innocent purchaser for value, that the fraud has not been purged, and that the court should leave the parties where it finds them.
