Savoy Finance Corp. v. DeLacey

Order of the County Court of Kings county reversed on the law, with ten dollars costs and disbursements, and motion to vacate and cancel the judgment granted, with ten dollars costs. The summons issued in the County Court was irregular and void, providing, as it did, that the defendants should appear or answer within six days. Under these eircumstanees the court was without power to compel an appearance or to impose costs. Kelly, P. J., Manning, Kelby, Young and Kapper, JJ., concur.
