Judgment of conviction of tbe County Court of Queens county affirmed. No opinion.

Kelly, P. J., Ricb and Manning, JJ.,. concur; Young and Kapper, JJ., dissent upon tbe ground that under tbe charge of illegal possession, it was error to admit tbe testimony of the- witness Flood (emphasized in tbe district attorney’s summation), that tbe beverage purchased by him affected bis sight and required him to obtain medical and hospital treatment therefor.
