Thyne v. United States Shipping Board Emergency Fleet Corp.
Appellate Division of the Supreme Court of New York · Decided January 15, 1927
219 A.D. 748
Thyne v. United States Shipping Board Emergency Fleet Corp.

Opinion of the Court

Judgment and order denying motion to set aside verdict reversed upon the law and the facts, and new trial granted, costs to abide the event, upon the ground that the verdict finding the ladder to have been attached in a defective and negligent condition, as well as the finding that plaintiff was injured while on the ladder, and not on the dock, was against the weight of the evidence. Kelly, P. J., Manning, Young, Kapper and Lazansky, JJ., concur.
