People v. Mouskajian

People v. Mouskajian
Appellate Division of the Supreme Court of New York · Decided March 15, 1929
226 A.D. 680
People v. Mouskajian

Opinion of the Court

Judgment of conviction of the County Court of Nassau county reversed upon the law and the facts, and a new trial ordered. We think that in the interests of justice there should be a new trial of this case. The competency of the evidence with regard to previous threats by defendant is very questionable. The demonstration by one of the jurors on the view of the automobile was likewise improper. Young, Hagarty, Seeger, Carswell and Seudder, JJ., concur.
