Muchnick v. Spitzbr
Appellate Division of the Supreme Court of New York · Decided March 15, 1930
228 A.D. 856
Muchnick v. Spitzbr

Opinion of the Court

Judgment in favor of respondents reversed upon the law and the facts, with costs, and complaints dismissed, with costs. The facts proved upon the trial were insufficient to constitute a cause of action, and justify a dismissal of the complaints. (Strasbourger v. Leerburger, 233 N. Y. 55.) Lazansky, P. J., Rich, Kapper, Hagarty and Scudder, JJ., concur.
