Order granting plaintiff’s motion for summary judgment unanimously reversed, with twenty dollars costs and disbursements, and the motion denied, and order denying defendant’s cross-motion for summary judgment unanimously affirmed, on the ground that triable issues are involved; and appeal from order denying defendant’s motion to vacate order granting plaintiff’s motion for summary judgment dismissed.
