Order in a taxpayer’s action granting the motion of defendant Barondess to dismiss the complaint as against him and denying plaintiff’s cross-motion to amend the bond and file it nunc pro tunc, and order granting the motion of defendant Barondess for a severance of the action and for judgment in his favor, and the judgment entered thereon, unanimously affirmed, with ten dollars costs and disbursements.
