Opinion of the Court

Judgment modified by making the sentence read as follows: “ The defendant, James Merton Haley, shall be confined in the State Prison at Dannemora, N. Y., under an indeterminate sentence, the minimum of which shall be one year and the maximum one year and one month; such sentence to be applied to each count; and the two sentences to be served concurrently.” The judgment, as so modified, is affirmed. Hill, P. J., Crapser, Bliss, Heffernan and Foster, JJ., concur.
