Present — Martin, P. J., O’Malley, Dore, Cohn and Callahan, JJ.; Dore, J., dissents and votes to reverse and grant the motion on the ground that the allegations in paragraph “ third ” of the complaint are merely general conclusions instead of allegations of fact.
