263 A.D. 732; 30 N.Y.S.2d 881; 1941 N.Y. App. Div. LEXIS 4750
Opinion of the Court
Appeal by defendant from a judgment of the Court of Special Sessions of the City of New York, Borough of Queens [County of Queens], convicting him of the crime of endangering the morals of a minor and assault in the third degree. Judgment reversed on the law and the facts, information dismissed and defendant discharged on the ground that the credible proof failed to establish the guilt of the defendant beyond a reasonable doubt. Lazansky, P. J., Hagarty, Adel, Taylor and Close, JJ., concur.
