The issue here involved is the same as in Purdy v. McGarity, decided herewith (262 App. Div. 623). Order unanimously affirmed, with ten dollars costs and disbursements upon the authority of Purdy v. McGarity (supra). Present — Hill, P. J., Crapser, Bliss, Sehenck and Foster, JJ.
