Decree affirmed, without costs of this appeal to any party. All concur, except Dowling and MeCurn, JJ., who dissent and vote for reversal on the law and facts and for granting a new trial, on the authority of Matter of Sadowski, 246 App. Div. 490, and Matter of Maiden, 284 N. Y. 429. (The decree awards letters of administration of decedent’s estate.) Present — Crosby, P. J., Taylor, Dowling, Harris and MeCurn, JJ.
