All concur. ’ (The judgment dismisses plaintiffs’ complaints as against defendant New York Central R. R. Co., on the merits at the close of plaintiffs’ ease, in actions for damages for the deaths of plaintiffs’ intestates, consolidated by court order. The order severed the action as to defendants and directed entry of judgment of dismissal. The action is under Federal Employers’ Liability Act [U. S. Code, tit. 45, §§ 51-60].) Present — Cunningham, Taylor, Dowling, Harris and McCurn, JJ.
