266 A.D. 764; 41 N.Y.S.2d 930; 1943 N.Y. App. Div. LEXIS 4313
Opinion of the Court
No opinion. Present—Martin, P. J., Townley, Glennon, Cohn and Callahan, JJ. Glennon and Cohn, JJ., concur on the ground that it appears from the uncontradicted evidence that plaintiff had been notified by defendant in October, 1933, of the entry of the judgment on the cross-complaint. Plaintiff is, accordingly, barred from maintaining this action against defendant by virtue of the two-year period of limitation contained in the policy of insurance.
