Kwiatek v. General Insurance
Appellate Division of the Supreme Court of New York · Decided December 30, 1943
267 A.D. 801; 47 N.Y.S.2d 290; 1943 N.Y. App. Div. LEXIS 6271
Kwiatek v. General Insurance

Opinion of the Court

Judgment and order reversed on the facts and a new trial granted, with costs to the appellant to abide the event, on the ground that the verdict is against the weight of the evidence. All concur, except Crosby, P. J., and Taylor, J., who dissent and vote for affirmance. (The judgment is for defendants for no cause of action in an action under fire insurance policies. The order denies plaintiff’s motion for a new trial.) Present — Crosby, P. J., Cunningham, Taylor, Dowling and Harris, JJ.
